Welcome to MAKEUPVISA, the website/platform (hereinafter referred to as “MAKEUPVISA,” “we,” “us,” or “our”), owned and managed by MAKEUPVISA.
Unless expressly agreed otherwise in writing through a separate agreement, the present Agreement governs the relationship between MAKEUPVISA and the Client/User (hereinafter referred to as “you,” “your,” or “Client”) and regulates your access to and use of all services, programs, content, and offerings provided by MAKEUPVISA.
This Agreement also governs the usage of www.makeupvisa.in
(hereinafter referred to as “the Website”) and all associated platforms, tools, learning management systems, communities, digital resources, and affiliated services operated by MAKEUPVISA.
We strongly recommend that you read this Agreement carefully before enrolling in or accessing any of our services.
By proceeding with registration, enrollment, or payment, you expressly acknowledge that:
You have read and understood all terms of this Agreement
You are aware of its scope, implications, and legal effect
You voluntarily agree to be bound by all terms and conditions herein, without limitation or qualification
1. Platform and Services: Introduction
MAKEUPVISA is a professional education, consulting, and business growth platform created to support beauty professionals, makeup artists, salon owners, educators, and entrepreneurs in building, scaling, and systemizing their businesses.
The platform is designed to provide practical, experience-backed knowledge, strategic frameworks, and actionable guidance through a combination of:
Digital learning modules and recordings
Live mentoring, coaching, and consulting sessions
Group sessions, community-based learning, and accountability systems
MAKEUPVISA aims to equip individuals and organizations with workable strategies and proven systems to strengthen existing businesses or to transform an idea into a structured, scalable, and sustainable business model.
The Consultant / Coach / Mentor shall use reasonable and best efforts to provide professional analysis, business evaluation, strategic insights, and recommendations based on their experience, expertise, and established consulting methodologies.
The Client clearly understands and agrees that:
All guidance, strategies, and recommendations provided by MAKEUPVISA are advisory in nature
Implementation, execution, and decision-making remain entirely the responsibility of the Client
MAKEUPVISA does not control or guarantee outcomes, results, profits, or performance
The Client agrees to exercise their independent judgment, discretion, and due diligence while applying any advice, strategies, or recommendations shared through the platform.
2. Deliverables
As part of this Agreement, and subject to full compliance with its terms, the Client shall be granted access to the following deliverables for the duration of the Program, unless otherwise specified by MakeupVisa:
2.1 Scope of Coaching and Consulting
MakeupVisa shall provide structured coaching and consulting support related to, but not limited to:
Business system creation and optimization
Business education and operational training
Team building, delegation, and workflow structuring
Brand positioning, messaging, and unique methodology development
Lead generation systems, funnels, and traffic strategies
Paid advertising strategies (including but not limited to Meta platforms)
Sales systems, conversion optimization, and client acquisition
Retention strategies and long-term client value building
The exact scope, depth, and focus of consulting shall be determined solely by MakeupVisa based on the Program structure and the Client’s stage of business.
2.2 Program Structure & Weekly Modules
Upon commencement of the Client’s assigned batch, the Client shall receive week-wise consulting modules and recorded sessions designed to guide implementation of specific action items during each phase of the Program.
These recordings are intended to serve as educational and implementation guidance tools and may be updated, replaced, or modified at the discretion of MakeupVisa.
Each Client shall be assigned one Accountability Manager, whose role shall include progress tracking, implementation guidance, and general accountability support, subject to platform rules and response timelines.
The indicative module structure includes, but is not limited to:
Week 1: Strategic Offer Architecture & Signature Offer Development Framework
Week 2: Funnel Design & Client Journey Structuring for Lead-to-Sale Conversion
Week 3: Creation, Execution, and Optimization of Profitable Paid Advertising Campaigns
Week 4: Email Marketing Automation, Nurture Sequences, and Advanced Scaling Systems
Note:
The remaining duration of the Program (up to 2 months) shall focus on advanced scaling strategies, sustainability planning, optimization techniques, and handling market saturation challenges.
2.3 Ongoing Support System
Each Client shall be provided access to a structured support ecosystem which may include:
Weekly live group sessions or business meets conducted online
Guidance from a success coach or authorized MakeupVisa representative
A centralized dashboard or system (where applicable) to monitor progress, tasks, and milestones
The frequency, format, and duration of such sessions may be revised at the sole discretion of MakeupVisa.
2.4 Rescheduling of Sessions
The Client acknowledges and agrees that if MakeupVisa or its consultants are unable to conduct any scheduled session due to circumstances beyond reasonable control (including but not limited to technical issues, health concerns, force majeure events, or operational constraints), such session shall be rescheduled at a mutually convenient time.
Rescheduling shall be the sole remedy available to the Client in such cases, and no refund or compensation shall arise from such rescheduling.
2.5 Right to Modify Program Content
MakeupVisa reserves the absolute right to revise, modify, update, replace, or restructure:
Course material
Consulting content
Session schedules
Program duration
Delivery formats
Such changes may be made without prior notice.
The Client expressly acknowledges that these modifications do not constitute a breach of this Agreement and shall not entitle the Client to any refund, compensation, or claim.
2.6 Implementation Submissions
The Client agrees that upon completion of tasks or assignments outlined in the Program recordings or live sessions, the Client may be required to submit their implementation work for review.
All such submissions must be sent only to the official MakeupVisa email address communicated to the Client.
Submissions sent via personal messages, alternate emails, or unofficial platforms shall not be considered valid.
2.7 Community & Email Support
MakeupVisa may provide additional support through:
A private community or group accessible only to enrolled Clients
Email-based support from a success coach or support representative
Support availability, response timelines, and scope shall be governed by internal protocols and may exclude weekends or public holidays unless expressly stated otherwise.
2.8 Access Duration
Unless otherwise specified in writing, access to:
Live consulting sessions
Community groups
Program content and recordings via the LMS
shall be provided for a total duration of three (3) months from the date of enrollment or batch commencement, whichever is applicable.
Access shall automatically expire upon completion of the Program duration, and continued access may require renewal or re-enrollment at the prevailing terms.
3. Fees, Payments, and Charges
3.1 Advance Payment Requirement
The Client agrees that enrollment in any course, program, coaching, or consulting service offered by MakeupVisa requires advance payment of the full fee as displayed on the official MakeupVisa platform, website, or communicated through authorized channels.
Access to any services, materials, sessions, community, or learning systems shall be granted only after successful receipt of payment.
3.2 Mode of Payment
All payments toward courses, programs, subscriptions, or consulting services shall be made exclusively through authorized third-party payment gateways as enabled on the MakeupVisa platform, including but not limited to Razorpay.
By completing a transaction, the Client agrees to be bound by the respective payment gateway’s terms of service, privacy policy, and transaction guidelines. MakeupVisa does not control and shall not be responsible for the operations or policies of such third-party platforms.
3.3 Confirmation of Enrollment
The Client’s enrollment shall be deemed confirmed only upon successful realization of full payment.
A payment and enrollment confirmation shall be communicated to the Client on the registered email address within forty-eight (48) hours of the successful transaction. MakeupVisa shall not be liable for delays caused due to incorrect email details provided by the Client.
3.4 Taxes and Statutory Charges
The Client acknowledges and agrees that they shall be solely responsible for payment of all applicable taxes, duties, levies, or statutory charges, including Goods and Services Tax (GST), as mandated under prevailing laws.
All fees displayed may be inclusive or exclusive of taxes, as specifically stated at the time of purchase.
3.5 Failed or Declined Transactions
In the event a payment is declined, reversed, or unsuccessful due to reasons attributable to the Client’s bank, card issuer, payment gateway, or insufficient funds, MakeupVisa shall not be obligated to provide access to any course, program, or service.
If a transaction reflects as debited from the Client’s account but access is not granted, the Client must notify MakeupVisa by email at the officially communicated support email address, along with complete transaction details.
Upon verification, such amount shall be either adjusted against enrollment or refunded (if eligible) within seven (7) working days.
3.6 Payment Security Disclaimer
MakeupVisa does not store, process, or retain any sensitive payment information, including but not limited to credit/debit card numbers, CVV, UPI credentials, or banking passwords.
All financial data is securely handled by the respective payment gateway. While reasonable measures are taken to ensure transaction security, MakeupVisa shall not be liable for any loss, damage, or unauthorized activity arising due to third-party system breaches beyond its reasonable control.
3.7 Program Fees
In consideration of the services outlined under Clause 2, the Client agrees to pay the consulting and program fee as specified at the time of enrollment.By way of illustration, a program fee may include a consolidated amount comprising:
Consulting and coaching fees
Platform access fees
Applicable Goods and Services Tax (GST)Upon successful receipt of the full payable amount, the Client shall be granted access to live sessions, recorded content, community platforms, and learning portals for the duration of the Program.
Note:
GST and other statutory taxes shall be levied strictly in accordance with applicable laws and government regulations in force at the time of payment.
4. Registration Procedures, Enrollment Process, Website Usage, and Functioning
MakeupVisa provides a structured and streamlined process for Clients to explore, apply for, and enroll in various courses, programs, and consulting services offered through its website and affiliated platforms.
The registration and enrollment process shall generally include the following steps:
4.1 Initial Inquiry and Application
The Client may initiate the enrollment process by:
Visiting the official MakeupVisa website or engaging through authorized online platforms
Reviewing available program previews, descriptions, and details to understand the nature of services offered
Submitting an inquiry, completing an application, or proceeding with payment and/or booking a consultation call, as applicable
Such steps are intended to collect necessary information required for assessing eligibility and onboarding.
4.2 Consultation Call
Upon submission of inquiry or application, the Client may receive a consultation or discovery call from MakeupVisa or its authorized team members, subject to availability and scheduling preferences.
The purpose of this call is to:
MakeupVisa reserves the right to approve or decline enrollment based on internal criteria.
4.3 Enrollment and Registration Fee
The Client may enroll in a selected program and reserve a slot by paying a non-refundable registration fee, if applicable, as communicated at the time of enrollment.
Any remaining balance amount must be paid within the specified time period (for example, within fourteen (14) days from the registration date) in order to confirm enrollment and secure batch allocation.
Failure to complete the balance payment within the stipulated timeline may result in automatic cancellation of enrollment.
4.4 Non-Completion of Payment
If the Client fails to complete payment as required under Clause 3 and Clause 4.3, MakeupVisa reserves the unrestricted right to:
In such cases, the Client expressly waives any right to claim a refund of the registration amount.
Any request for delayed payment or grievance must be submitted within three (3) days of payment of the registration fee and shall be considered solely at MakeupVisa’s discretion.
4.5 Submission of Information and Documents
The Client agrees to provide all required information, documentation, or clarifications requested by MakeupVisa within seven (7) days from the date of such request.
All submissions must be sent only to MakeupVisa’s officially communicated email address. Failure to provide required information within the stipulated timeframe may result in delayed onboarding, suspension, or termination of access.
4.6 Personal Data Updates
The Client may request changes or corrections to their personal data by submitting a written request to MakeupVisa through the official support email address.
MakeupVisa reserves the right to modify, correct, or delete inaccurate, incomplete, or irrelevant data provided by the Client, in compliance with applicable data protection laws.
4.7 Attendance by Additional Team Member
Only one (1) additional team member may be permitted to attend live sessions along with the Client, subject to prior approval by MakeupVisa.
Conditions applicable:
The session access link shall be shared exclusively with the Client and may be forwarded only to the approved team member.
Any unauthorized sharing or additional participation shall constitute a material breach and may result in termination of access without refund, along with legal consequences for breach of confidentiality.
4.8 Assignments and Implementation Review
Once the Program commences and LMS access is granted, the Client shall be assigned weekly or periodic implementation tasks.
The Client agrees to:
Submissions made via personal messages, alternate emails, or unofficial channels shall not be accepted or reviewed.
4.9 Community Access
The MakeupVisa community is a private and exclusive group available only to enrolled Clients who have completed full payment obligations.
Community access shall be granted at MakeupVisa’s discretion and may be revoked in case of violation of terms or community guidelines.
4.10 Official Communication
All official communication between the Client and MakeupVisa shall be conducted only via officially designated email addresses or platforms.
If the Client requires leave or is unable to attend any scheduled session, prior written intimation must be provided through official communication channels.
4.11 Deferral of Enrollment
In exceptional circumstances, MakeupVisa may, at its sole discretion, allow the Client to defer enrollment to a future batch.
Deferral conditions include:
No deferral or extension requests shall be entertained after expiry of the original access period.
4.12 Technical Support
MakeupVisa endeavors to maintain reliable and functional systems.
In the event of any technical issue or platform malfunction:
MakeupVisa shall not be liable for interruptions caused by external service providers or circumstances beyond reasonable control.
4.13 Operational Discretion
The procedures outlined above may be modified at any time due to operational requirements, technical limitations, system upgrades, personnel availability, or platform restructuring.
Clients shall not contact MakeupVisa team members via personal phone calls, messages, or unapproved communication channels.
Support protocols shall be explained prior to program commencement, and any requests outside the defined protocol shall not be entertained.
4.14 Website Disclaimer
MakeupVisa does not warrant that:
No representations or warranties are made regarding accuracy, reliability, timeliness, or results arising from the use of the website, materials, or third-party links.
5. Prohibited Conduct on the Website and Platform
All users, clients, and visitors accessing the MakeupVisa website, portal, learning systems, or affiliated platforms agree to refrain from engaging in any conduct that violates this Agreement, applicable laws, or the rights of others.
Without limitation, the following actions are strictly prohibited:
5.1 Interference with Platform Use
Engaging in any activity that restricts, disrupts, inhibits, or interferes with another user’s ability to access, use, or benefit from the MakeupVisa website, platform, or services.
5.2 Impersonation and Misrepresentation
Impersonating any individual, business, or entity, or falsely claiming affiliation, endorsement, or association with any person or organization without lawful authorization.
5.3 System Interference
Interfering with, damaging, or disrupting servers, networks, systems, or infrastructure used to operate the website or its features, or failing to comply with network policies, protocols, or security requirements.
5.4 Illegal or Harmful Activities
Using the platform to promote, encourage, facilitate, or engage in unlawful activities, or to cause harm, injury, loss, or damage to any person, property, or entity.
5.5 Unauthorized Access
Attempting to gain, or gaining, unauthorized access to any part of the website, accounts, databases, systems, or networks through hacking, password mining, phishing, or any unlawful or unethical means.
5.6 Unauthorized Data Collection
Attempting to obtain or extract any information, data, or materials from the platform through methods not intentionally made available by MakeupVisa.
5.7 Prohibited Content
Posting, uploading, sharing, or transmitting any content that is unlawful, abusive, threatening, defamatory, obscene, vulgar, pornographic, profane, misleading, or otherwise objectionable, or that may encourage criminal conduct or civil liability.
5.8 Intellectual Property Violations
Posting or transmitting content that infringes upon the intellectual property, privacy, publicity, or proprietary rights of any third party without prior written authorization from the rightful owner.
5.9 Malware and Harmful Code
Uploading, transmitting, or distributing viruses, malware, spyware, ransomware, or any other harmful or disruptive software or components that may damage or compromise systems or data.
5.10 Unauthorized Commercial Use
Using, reproducing, distributing, or exploiting any content, software, recordings, or materials from the platform for commercial purposes, promotional use, or resale without prior written consent from MakeupVisa.
5.11 Unauthorized Advertising and Solicitation
Using the platform to advertise, market, solicit, or promote the sale or purchase of products or services, request donations, or conduct promotions without the express written permission of MakeupVisa.
5.12 Data Harvesting
Collecting, scraping, harvesting, or storing personal information, email addresses, or contact details of other users for marketing, solicitation, or any unauthorized purpose.
5.13 Enforcement
Any violation of this Section may result in immediate suspension or termination of access, removal from the platform or community, forfeiture of fees paid, and/or legal action as deemed appropriate by MakeupVisa.
6. Defamation and Reputational Harm
The Client agrees that they shall not, directly or indirectly, engage in any act that may damage, disparage, or negatively impact the reputation, goodwill, credibility, or public image of MakeupVisa, its founders, mentors, employees, affiliates, programs, or services.
This includes, but is not limited to:
Any such act shall constitute a material breach of this Agreement, entitling MakeupVisa to:
The Client further agrees not to participate in, promote, or associate with any group or activity whose purpose or effect is to defame, harass, or discredit MakeupVisa or its stakeholders.
7. Public Forums and User-Generated Content
7.1 Platform Forums
MakeupVisa may host discussion boards, chat rooms, community groups, or other interactive forums intended for professional discussion and learning among enrolled users.
7.2 Moderation Rights
Any user violating this Agreement may be removed from such forums and denied future access at MakeupVisa’s sole discretion.
MakeupVisa reserves the unrestricted right to edit, remove, restrict, or moderate any user-generated content without notice.
7.3 Third-Party Content Disclaimer
Content shared within forums may originate from other users or staff members. MakeupVisa does not endorse, verify, or guarantee the accuracy of third-party content unless explicitly posted by an authorized administrator.
7.4 Limitation of Responsibility
MakeupVisa shall not be responsible for errors, omissions, opinions, advice, or links shared by users. Reliance on such content is strictly at the Client’s own risk.
7.5 Independent Opinions
All opinions expressed within forums are personal to the individual users and do not reflect the views or positions of MakeupVisa.
7.6 Monitoring Rights
While MakeupVisa is not obligated to monitor content, it retains the absolute right to monitor, review, and regulate forum activity to ensure compliance with this Agreement.
8. Affiliate and Third-Party Link Disclosure
8.1 Affiliate Links
Some links shared through the website, programs, or communications may be affiliate links. MakeupVisa may earn a commission at no additional cost to the Client.
8.2 Third-Party Responsibility
MakeupVisa does not control or govern third-party platforms, products, or services. Any interaction or transaction with third parties is solely between the Client and the third party.
8.3 Independent Decision-Making
Recommendations are made in good faith; however, the decision to purchase or engage with third-party services rests entirely with the Client.
8.4 No Price Impact
Affiliate relationships do not affect the pricing paid by the Client or the objectivity of MakeupVisa’s content.
8.5 Disclaimer of Liability
MakeupVisa shall not be liable for disputes, losses, or damages arising from third-party products or services. Clients are advised to conduct independent due diligence.
8.6 “As-Is” Disclaimer
All products and services are provided “as is”, without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability.
9. Client Obligations and General Disclaimers
The Client agrees to:
9.1 Payment Compliance
Make all required payments in advance to access services and materials.
9.2 Policy Compliance
Comply with all present and future policies, guidelines, and terms issued by MakeupVisa.
9.3 Account Security
Not share access credentials or materials with unauthorized parties and remain fully responsible for account misuse.
9.4 Intellectual Property Protection
Not copy, reproduce, distribute, modify, or misuse any content without written authorization.
9.5 Marketing Permission
Permit MakeupVisa to reference the Client’s success or association for marketing or promotional purposes unless objected to in writing.
9.6 Consequences of Breach
Any violation may result in termination of access without refund.
10. Termination
10.1 Unprofessional Conduct
MakeupVisa may terminate access immediately for unprofessional behavior, including misconduct, disruption, abuse, or intellectual property violations, without refund.
10.2 Non-Cooperation
Failure to implement instructions, comply with systems, or cooperate with processes may result in suspension or termination without compensation.
11. Effects of Termination
Upon termination:
Surviving clauses shall remain enforceable post-termination.
12. Refund Policy
MakeupVisa does not guarantee results or outcomes.
A limited 7-day refund window applies strictly from the date of enrollment.
Refunds shall not be granted if:
Reactivation after pause may require a reactivation fee.
Fee revisions shall not affect payments already made.
13. Confidential Information
13.1 Definition
Confidential Information includes all proprietary materials, recordings, frameworks, strategies, documents, templates, and communications shared by MakeupVisa.
13.2 Non-Disclosure
Clients shall not disclose, copy, or misuse confidential information without written consent.
13.3 Legal Disclosure
Information may be disclosed if required by law or legal process.
13.4 Injunctive Relief
Breach may cause irreparable harm, entitling MakeupVisa to injunctive and legal relief.
13.5 Return or Destruction
Upon termination, all confidential materials must be returned or destroyed.
14. Intellectual Property Rights
All materials, systems, content, and methodologies remain the exclusive property of MakeupVisa.
No ownership rights are transferred to the Client.
15. Indemnification
The Client agrees to indemnify and hold harmless MakeupVisa against losses arising from:
These obligations survive termination.
16. Limitation of Liability
MakeupVisa shall not be liable for indirect, incidental, or consequential damages.
Total liability shall not exceed the amount paid by the Client.
17. After-Sales Services
Access to LMS, content, and community ends upon program completion unless renewed.
MakeupVisa may discontinue after-sales support at its discretion.
18. Publicity and Results Display
MakeupVisa may publicly display Client success stories unless objected to in writing.
No confidential client materials will be used without consent.
19. Transfer of Access Rights
Access is non-transferable.
Unauthorized sharing or assignment constitutes breach and forfeiture of fees.
20. Severability
If any provision is held unenforceable, the remainder of the Agreement shall remain valid.
21. Dispute Resolution and Governing Law
All disputes shall be resolved through binding arbitration under the Indian Arbitration and Conciliation Act, 1996.
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements.
22. Survival
All provisions of this Agreement which by their nature are intended to survive, including but not limited to clauses relating to confidentiality, intellectual property, non-compete, indemnification, limitation of liability, dispute resolution, and governing law, shall survive the expiration or termination of this Agreement.
Termination or expiration of this Agreement shall not limit or prejudice any other rights or remedies available to MakeupVisa at law or in equity.
23. Non-Disclosure and Non-Compete
23.1 Confidentiality Obligation
The Client agrees to maintain strict confidentiality and shall not, without prior written consent from MakeupVisa, use, disclose, commercialize, copy, or disseminate any MakeupVisa Confidential Information, except as expressly permitted under this Agreement.
23.2 Duty of Care
The Client undertakes to exercise at least the same degree of care in safeguarding MakeupVisa Confidential Information as they would exercise to protect their own confidential information, and shall take all reasonable measures to prevent unauthorized access, disclosure, or misuse.
23.3 Continuing Obligation
The obligation to maintain confidentiality shall continue indefinitely, regardless of whether this Agreement expires or is terminated for any reason.
23.4 Non-Compete Restriction
In consideration of access to MakeupVisa’s proprietary systems, methodologies, and confidential information, the Client agrees that they shall not, directly or indirectly, compete with the business of MakeupVisa, its successors, or assigns:
23.5 Injunctive Relief
The Client acknowledges that any breach of confidentiality or non-compete obligations may result in irreparable harm to MakeupVisa, which may not be adequately compensable through monetary damages alone.
Accordingly, MakeupVisa shall be entitled to seek injunctive relief, equitable remedies, and any other relief available under applicable law, without prejudice to its other rights.
23.6 Policy Amendments
MakeupVisa reserves the right to amend, update, or revise this Agreement and its policies at any time.
The Client agrees to remain informed of such updates, which shall be made available on MakeupVisa’s official website or platform.
Any matters not expressly covered under this Agreement shall be governed by standard business practices applicable to services of this nature, at MakeupVisa’s discretion.
Note:
This clause shall survive the expiration or termination of this Agreement, and the Client undertakes full compliance irrespective of the status of the contractual relationship.
24. Miscellaneous
24.1 Entire Agreement
This Agreement constitutes the entire understanding between the Client and MakeupVisa and supersedes all prior discussions, representations, negotiations, or agreements, whether oral or written, relating to the subject matter herein.
24.2 Waiver
Failure or delay by either party to enforce any provision of this Agreement shall not constitute a waiver of such provision.
No waiver shall be effective unless expressly made in writing and signed by the waiving party.
24.3 Force Majeure
Except for payment obligations, neither party shall be held liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:
Such events shall constitute a Force Majeure Event, and obligations shall remain suspended for the duration of such event.
25. Definitions
For the purpose of this Agreement, the following terms shall have the meanings assigned below:
25.1 Time of Subscription
The moment when the Client agrees to this Agreement and successfully completes payment for a selected course or program.
25.2 Acceptance of Agreement
This Agreement shall be deemed accepted when:
25.3 Service Product
All educational content, courses, coaching sessions, materials, recordings, frameworks, templates, and resources provided by MakeupVisa in exchange for payment, whether or not designated as Confidential Information.
25.4 Non-Individual Client
Any entity, firm, company, partnership, or organization consisting of more than one individual.
25.5 Disclosing Party
The party that discloses confidential information under this Agreement.
25.6 Recipient Party
The party that receives confidential information under this Agreement.
25.7 Client
Any individual or entity that enters into and is bound by the terms of this Agreement.
25.8 Surviving Clauses
Any provisions which, by their nature or express declaration, continue to apply after expiration or termination of this Agreement.
25.9 MakeupVisa Confidential Information
